These Terms & Conditions apply to orders placed on or after October 16, 2026. Orders placed before this date remain subject to the Terms & Conditions in effect when the order was placed.

Welcome to Amethyst Creek Farm. By accessing our website, placing an order, or purchasing products from Amethyst Creek Farm, you agree to the following Terms & Conditions.

Orders & Acceptance

All orders are subject to availability and acceptance.

• We reserve the right to limit, refuse, or cancel orders at our discretion.

• If Amethyst Creek Farm cancels an unfulfilled order, the amount paid for the cancelled merchandise will be refunded.

• Product availability may change due to weather, crop conditions, disease, harvest results, agricultural loss, regulatory requirements, or the nature of live inventory.

Pre-Orders & Seasonal Shipping

All plant orders are sold as pre-orders unless expressly stated otherwise.

• Plant orders generally ship during our seasonal window of July through October.

• Orders are fulfilled based on crop readiness, weather, harvest conditions, agricultural requirements, and regulatory requirements.

• Orders do not ship immediately when purchased.

• Shipping dates are estimates and may change when conditions outside our control affect harvest or fulfillment.

Shipping

Shipping charges may be based on:

• USPS Priority Mail or other applicable carrier rates

• Packaging requirements

• Order size and weight

• Agricultural inspection, treatment, documentation, or other compliance requirements

A surcharge may be applied to cover handling, packaging materials, inspection, and compliance costs.

By placing an order, you also agree to our full Shipping Policy.

Order Fulfillment

Orders are fulfilled individually in the order in which they are received.

• Multiple orders placed by the same customer are treated as separate orders.

• Each order is processed, packed, and fulfilled independently.

• Shipping charges apply to each order as placed.

• Separate orders are not automatically combined for fulfillment or shipping.

Shipping Insurance & Carrier Issues

• Shipping insurance is required or included on plant shipments when available.

• Once an order is transferred to the carrier, delays, mishandling, loss, or damage occurring in transit may be subject to the carrier claims process.

• Customers should notify Amethyst Creek Farm promptly if a shipment arrives damaged or appears lost so that appropriate records and documentation can be reviewed.

Live Plant Disclaimer

Live plants are perishable agricultural products and naturally vary in size, appearance, root structure, foliage, and condition throughout the growing and shipping season.

• Plants are inspected and shipped as viable plant material at the time of fulfillment.

• Iris foliage and roots may be trimmed before shipment.

• Drying, yellowing, browning, trimmed foliage, trimmed roots, cosmetic blemishes, and temporary shipping stress do not by themselves indicate that a plant is unhealthy or nonviable.

• Rhizome size and appearance may vary by cultivar and growing habit.

• We do not guarantee plant performance, establishment, survival, rebloom, or bloom after planting because growing and environmental conditions are outside our control.

Fulfillment Documentation & Customer Claims

Amethyst Creek Farm may maintain fulfillment records, including packing slips, shipping records, inventory records, and photographs taken during packing or fulfillment. These records may be used to verify the contents and condition of an order before shipment.

Customers should inspect orders promptly upon receipt.

If an item is believed to be missing, incorrect, damaged, or nonviable, contact Amethyst Creek Farm promptly and provide sufficient information for review, which may include:

• Order number

• Cultivar or product involved

• Photographs of the product or plant material in question

• Photographs of labels and packaging when applicable

Amethyst Creek Farm may review its fulfillment documentation together with customer-provided information before determining an appropriate resolution.

A cosmetic concern alone does not necessarily constitute a defective or nonviable product.

Returns & Refunds

Live Plants

Live plants are final sale and are not normally returnable.

Because live plants are perishable agricultural products and cannot simply be returned to ordinary saleable inventory, unauthorized returns of live plant material will not be accepted.

Do not return live plant material without prior written authorization and a valid Return Merchandise Authorization (RMA) number.

Non-Plant Products

• Issues with non-plant products must be reported within 7 days of delivery.

• Items eligible for return must be unused and in original condition unless Amethyst Creek Farm authorizes otherwise in writing.

• Available resolutions may include replacement, store credit, refund, or an authorized return depending on the circumstances.

Authorized Returns — All Products

At its sole discretion, Amethyst Creek Farm may authorize a return as a customer-service exception.

Any authorization applies only to the specific order and products identified in writing and does not change our general policy or create a right to return other purchases.

Return Merchandise Authorization (RMA)

A valid RMA number is required for every approved return.

An RMA number will be issued by Amethyst Creek Farm when a return is approved. The RMA number must be included with the return shipment.

Returns sent without prior written authorization or without a valid RMA number may be refused or may experience processing delays.

Unless Amethyst Creek Farm agrees otherwise in writing:

• Written authorization and a valid RMA number must be obtained before the return is shipped.

• The customer is responsible for return shipping costs.

• Original shipping, handling, inspection, compliance, and other shipping-related charges are nonrefundable.

• The complete authorized product or shipment must be returned, including product labels, identifying materials, and included components when applicable.

• Returned products are subject to inspection upon receipt.

• A 30% restocking and reprocessing fee will be deducted from the eligible merchandise value of the authorized return.

• The fee helps cover receiving, inspection, handling, administrative processing, inventory reconciliation, relabeling, repackaging, reconditioning, and, for live plant material, agricultural handling and replanting.

• The maximum refund for an authorized return subject to the fee is therefore 70% of the eligible returned merchandise value.

• No refund will be issued for an item that is not returned when return of that item was required as part of the authorized resolution.

Farm Error or Verified Defect

Amethyst Creek Farm may waive the restocking and reprocessing fee and/or return-shipping responsibility when we determine that a return is required because of our fulfillment error, an incorrect product, or a verified defect present at fulfillment.

Any waiver must be confirmed in writing.

Missing or Unfulfilled Items

If Amethyst Creek Farm determines that an ordered item was inadvertently omitted and was not otherwise substituted, credited, or refunded, we will provide an appropriate resolution for that item.

Depending on the circumstances, the resolution may include:

• Refund of the purchase price of the missing item

• Store credit

• Replacement when available

• Another mutually agreed resolution

A refund for an omitted item does not include reimbursement of shipping charges attributable to merchandise that was successfully delivered.

Order Cancellations

Due to the seasonal and limited nature of live plant inventory, plant orders are considered final when placed.

If circumstances require cancellation before fulfillment, Amethyst Creek Farm may, at its sole discretion, issue store credit equal to the eligible amount paid, less non-recoverable processing fees.

• Store credits do not expire.

• Store credits may be applied toward future eligible purchases.

• Once an order has entered harvest, processing, packing, inspection, or shipping preparation, cancellation is not available.

Why We Do Not Offer Routine Refunds for Cancellations

Amethyst Creek Farm is a small family farm. When an order is placed, inventory is reserved specifically for that customer and may no longer be available to others.

Live agricultural inventory is grown, maintained, harvested, cleaned, processed, labeled, and reserved seasonally. For that reason, approved pre-shipment cancellations are generally resolved through store credit rather than monetary refund.

Substitutions

If a cultivar or product becomes unavailable, the resolution will be based on the customer's selected substitution preference when available and the circumstances of fulfillment.

A resolution may include:

• A comparable substitution

• Store credit

• A refund for the unavailable item

• Another resolution communicated by Amethyst Creek Farm

Agricultural losses may occasionally make exact fulfillment impossible.

Pricing & Payments

• All prices are stated in U.S. dollars.

• Payment is required at the time the order is placed.

• We reserve the right to correct pricing or listing errors.

Limitation of Liability

To the fullest extent permitted by applicable law:

• Amethyst Creek Farm is not liable for indirect, incidental, special, or consequential damages.

• Liability arising from a product claim is limited to the amount paid for the product giving rise to the claim.

Nothing in these Terms & Conditions is intended to limit any right or remedy that cannot legally be waived under applicable law.

Agricultural Compliance

Amethyst Creek Farm is a licensed nursery in the State of Idaho.

• Orders may be subject to state, federal, or destination-specific agricultural regulations.

• We reserve the right to delay, modify, refuse, or cancel a shipment when necessary to comply with applicable agricultural requirements.

Use of Website

You agree not to:

• Use the website for unlawful purposes

• Interfere with website functionality

• Submit false or misleading order information

• Misrepresent information related to an order, delivery, return, refund request, or claim

Changes to Terms

We reserve the right to update these Terms & Conditions.

Changes will be posted with an updated effective date.

Prior versions are retained by Amethyst Creek Farm for recordkeeping purposes. Unless otherwise required by law, the Terms & Conditions applicable to an order are those in effect when the order was placed.

📦 Shipping

Shipping is calculated based on:

• USPS Priority Mail rates

• Packaging requirements

• Order size

A flat surcharge may be applied per order to cover handling, materials, and compliance costs.

📬 Combined Shipping

All items are shipped together by default to reduce shipping costs.

• Non-plant items will be held until plant shipping season unless otherwise requested

• Customers may select expedited or separate shipping options when available

🛡️ Shipping Insurance & Liability

• Shipping insurance is required/included on all orders

• Once an order is transferred to the carrier, liability transfers to the carrier

• Amethyst Creek Farm is not responsible for delays, damage, or loss during transit

Customers are responsible for filing claims directly with the carrier.

🌿 Live Plant Disclaimer

Live plants are perishable and subject to environmental conditions.

• Plants are shipped healthy and viable at the time of shipment

• We do not guarantee plant performance, survival, or bloom after planting

• Growing results will vary based on conditions outside our control

🔄 Returns & Refunds

Plants:

• No returns accepted on live plants

Non-Plant Items:

• Issues must be reported within 7 days of delivery

• Items must be unused and in original condition

• Resolutions may include replacement, store credit, or refund

 

Order Cancellations

Due to the seasonal and limited nature of live plant inventory, orders are considered final when placed. If circumstances require cancellation prior to shipment, Amethyst Creek Farm may, at its sole discretion, issue a store credit equal to the amount paid, less any non-recoverable processing fees. Store credits do not expire and may be applied toward future purchases. Once an order has entered processing or shipping preparation, cancellations are not available.

 

Why don't we offer refunds?

Amethyst Creek Farm is a small family farm. When an order is placed, inventory is reserved specifically for that customer and may no longer be available to others. Unlike large retailers, we are unable to absorb frequent order cancellations and refunds. To remain fair to all customers while protecting the farm's limited inventory, approved cancellations are issued as store credit rather than monetary refunds.
